{"id":7698,"date":"2023-10-25T18:05:02","date_gmt":"2023-10-25T18:05:02","guid":{"rendered":"https:\/\/gest-bau.es\/loe-38-1999-las-garantias-en-la-obra-nueva"},"modified":"2023-10-26T17:55:26","modified_gmt":"2023-10-26T17:55:26","slug":"loe-38-1999-las-garantias-en-la-obra-nueva","status":"publish","type":"post","link":"https:\/\/gest-bau.es\/ca\/loe-38-1999-las-garantias-en-la-obra-nueva","title":{"rendered":"LOE 38\/1999: Les Garanties a l&#8217;Obra Nova"},"content":{"rendered":"\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"742\" height=\"494\" src=\"https:\/\/gest-bau.es\/wp-content\/uploads\/2023\/10\/Imagen-para-Gast-Bau.jpg\" alt=\"\" class=\"wp-image-7689\" srcset=\"https:\/\/gest-bau.es\/wp-content\/uploads\/2023\/10\/Imagen-para-Gast-Bau.jpg 742w, https:\/\/gest-bau.es\/wp-content\/uploads\/2023\/10\/Imagen-para-Gast-Bau-300x200.jpg 300w\" sizes=\"auto, (max-width: 742px) 100vw, 742px\" \/><\/figure>\n\n\n\n<p class=\"has-medium-font-size\">La responsabilitat civil dels agents que intervenen en el proc\u00e9s d\u2019edificaci\u00f3 es regula a l\u2019article 17.1 de la LOE, que estableix el seg\u00fcent:<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Els agents que intervenen en el proc\u00e9s d\u2019edificaci\u00f3, tant persones f\u00edsiques com jur\u00eddiques, han de respondre davant els propietaris i els compradors dels edificis o parts d\u2019aquests, si es divideixen, pels danys materials que es produeixen a l\u2019edifici dins de certs per\u00edodes, que comencen quan es rep l\u2019obra sense reserves o des de quan es resolen les reserves que hi hagi hagut.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Els per\u00edodes de responsabilitat s\u00f3n els seg\u00fcents:<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size\">Deu anys per als danys materials que afecten l\u2019estabilitat i la resist\u00e8ncia de l\u2019edifici, com ara els que es produeixen a la fonamentaci\u00f3, els suports, les bigues, les lloses, els murs de c\u00e0rrega o altres elements estructurals.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Tres anys per als danys materials que impedeixen l\u2019\u00fas adequat de l\u2019edifici, com ara els que es produeixen en els elements constructius o les instal\u00b7lacions que no compleixen amb els requisits d\u2019habitabilitat de l\u2019article 3.1.c) de la <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1999-21567\">LOE<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Un any per als danys materials que nom\u00e9s afecten el acabat o la finalitzaci\u00f3 de les obres, com ara els que es produeixen en elements de decoraci\u00f3 o remat. Nom\u00e9s el constructor \u00e9s responsable d\u2019aquests danys.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Per calcular aquests per\u00edodes, cal tenir en compte la data de recepci\u00f3 de l\u2019obra o la data en qu\u00e8 es considera t\u00e0citament rebuda si el promotor no posa objeccions en trenta dies des de qu\u00e8 se li notifica el certificat final d\u2019obra.
