{"id":7699,"date":"2023-10-25T18:05:02","date_gmt":"2023-10-25T18:05:02","guid":{"rendered":"https:\/\/gest-bau.es\/loe-38-1999-las-garantias-en-la-obra-nueva"},"modified":"2023-10-26T16:49:31","modified_gmt":"2023-10-26T16:49:31","slug":"loe-38-1999-las-garantias-en-la-obra-nueva","status":"publish","type":"post","link":"https:\/\/gest-bau.es\/en\/loe-38-1999-las-garantias-en-la-obra-nueva","title":{"rendered":"LOE 38\/1999: Guarantees in New Construction"},"content":{"rendered":"\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"742\" height=\"494\" src=\"https:\/\/gest-bau.es\/wp-content\/uploads\/2023\/10\/Imagen-para-Gast-Bau.jpg\" alt=\"\" class=\"wp-image-7689\" srcset=\"https:\/\/gest-bau.es\/wp-content\/uploads\/2023\/10\/Imagen-para-Gast-Bau.jpg 742w, https:\/\/gest-bau.es\/wp-content\/uploads\/2023\/10\/Imagen-para-Gast-Bau-300x200.jpg 300w\" sizes=\"auto, (max-width: 742px) 100vw, 742px\" \/><\/figure>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The civil liability of the agents involved in the building process is regulated in Article 17.1 of the LOE, which establishes the following:<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">The agents involved in the building process, both natural and legal persons, must respond to the owners and buyers of the buildings or parts thereof, if they are divided, for the material damages that occur in the building within certain periods, which start from when the work is received without reservations or from when any reservations that there may have been are resolved.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\"><strong>The periods of liability are as follows:<\/strong><\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Ten years for material damages that affect the stability and resistance of the building, such as those that occur in the foundation, supports, beams, slabs, load-bearing walls or other structural elements.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">Three years for material damages that prevent the proper use of the building, such as those that occur in the construction elements or installations that do not meet the habitability requirements of Article 3.1.c) of the <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1999-21567\">LOE<\/a>.<\/p>\n\n\n\n<p class=\"has-medium-font-size wp-block-paragraph\">One year for material damages that only affect the finish or completion of the works, such as those that occur in decoration or finishing elements. Only the builder is responsible for these damages. To calculate these periods, one must take into account the date of receipt of the work or the date on which it is tacitly understood to have been received if the developer does not object within thirty days from being notified of the final certificate of work.
